1. Agreement to Terms
Welcome to Roundpass. These Terms of Service ("Terms") govern your access to and use of the Roundpass platform, including our website, applications, and AI-powered interview practice services (collectively, the "Service").
By creating an account or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
2. Description of Service
Roundpass is an AI-powered interview practice platform that provides:
- Real-time voice-based interview simulations with an AI interviewer
- Personalized interview questions based on your resume and target role
- Detailed performance analytics and feedback reports
- Speaking metrics analysis (pace, filler words, structure)
- Progress tracking across multiple practice sessions
The Service is designed to help users improve their interview skills and is for practice purposes only. We do not guarantee any specific outcomes or job placement results.
3. Account Registration
To use the Service, you must create an account. When registering, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Keep your account credentials secure and confidential
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use of your account
You must be at least 18 years old to create an account and use the Service.
4. Credits and Payments
4.1 Credit System
Roundpass operates on a credit-based system:
- New users receive free credits upon registration
- Each credit allows for one 30-minute interview practice session
- Credits are non-transferable between accounts
- Purchased credits expire 90 days after purchase
4.2 Pricing
Current credit package pricing is published on our Pricing page. Prices are subject to change. Any price changes will not affect credits already purchased.
4.3 Payment Processing
All payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service. We do not store your credit card information on our servers.
4.4 Refunds
All credit purchases are final and non-refundable, except as required by applicable law. If you experience technical issues that prevent you from completing a session, please contact us and we may issue a credit refund at our discretion.
5. Acceptable Use
When using the Service, you agree not to:
- Violate any applicable laws, regulations, or third-party rights
- Use the Service for any fraudulent, deceptive, or illegal purpose
- Attempt to gain unauthorized access to the Service or its systems
- Interfere with or disrupt the Service or servers
- Reverse engineer, decompile, or attempt to extract the source code
- Use automated systems (bots, scrapers) to access the Service
- Share your account credentials with others
- Upload malicious content, viruses, or harmful code
- Use the Service to harass, abuse, or harm others
- Misrepresent your identity or affiliation
6. User Content
6.1 Your Content
You retain ownership of content you provide to the Service, including your resume, job descriptions, and interview responses ("User Content"). By uploading User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, store, and analyze your content solely for the purpose of providing and improving the Service.
6.2 Content Responsibility
You are solely responsible for your User Content. You represent that:
- You have all necessary rights to upload and share the content
- Your content does not violate any third-party rights
- Your content is accurate and not misleading
7. Intellectual Property
The Service, including its original content, features, functionality, and underlying technology, is owned by Roundpass and is protected by copyright, trademark, and other intellectual property laws.
Our AI-generated interview questions, feedback reports, and analytics are proprietary. You may use these materials for personal interview preparation but may not:
- Redistribute or sell our content
- Use our content to train competing AI systems
- Remove any copyright or proprietary notices
8. AI-Generated Content Disclaimer
The Service uses artificial intelligence to generate interview questions and provide feedback. You acknowledge that:
- AI-generated content may not always be accurate or appropriate
- Feedback is algorithmic and should not be considered professional career advice
- The Service is for practice purposes and does not guarantee job interview success
- You should use your own judgment when applying feedback
9. Privacy
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information. By using the Service, you consent to our data practices as described in the Privacy Policy.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
We do not warrant that:
- The Service will be uninterrupted, secure, or error-free
- Results from the Service will be accurate or reliable
- The Service will meet your specific requirements or expectations
- Any errors in the Service will be corrected
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROUNDPASS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.
Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless Roundpass and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.
13. Your Data and Account Deletion
13.1 Your Right to Delete Your Data
You have the right to delete your data at any time. Through your Privacy Settings, you can:
- Delete individual or all interview sessions, including transcripts, recordings, and performance reports
- Delete all saved roles and job descriptions
- Delete your entire account and all associated data
Data deletion is permanent and cannot be undone. When you delete data, it is removed from our active systems. We do not retain copies of deleted data except where required by law (e.g., billing records).
13.2 Account Termination
We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for violation of these Terms.
You may delete your account at any time through your Privacy Settings. Upon account deletion:
- Your right to use the Service will immediately cease
- All your data, including interview sessions, resumes, roles, and performance reports, will be permanently deleted
- Unused credits will be forfeited and are non-refundable
- Your authentication sessions will be revoked
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of Delaware.
15. Dispute Resolution
Before filing a legal claim, you agree to try to resolve any dispute informally by contacting us. If we cannot resolve the dispute informally within 30 days, either party may proceed with formal legal action.
You agree to resolve any disputes on an individual basis and waive any right to participate in class actions or class arbitrations.
16. General Provisions
- Entire Agreement: These Terms constitute the entire agreement between you and Roundpass regarding the Service.
- Severability: If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
- Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver.
- Assignment: You may not assign your rights under these Terms without our consent. We may assign our rights at any time.
